A corrupt practice is the offering, giving, receiving, or soliciting, directly or indirectly, anything of value to influence improperly the actions of another party. ? A fraudulent practice is any action or omission, including a misrepresentation, that knowingly or recklessly misleads, or attempts to mislead, a party to obtain a financial or other benefit or to avoid an obligation. ? A coercive practice is impairing or harming, or threatening to impair or harm, directly or indirectly, any party or the property of the party, to influence improperly the actions of a party. ? A collusive practice is an arrangement between two or more parties designed to achieve an improper purpose, including influencing improperly the actions of another party. ? Foreword increasing the understanding of and compliance with ADB's anticorruption policy and raising the awareness of potential irregularities throughout the project organizations implementing these projects, including representatives of executing and implementing agencies, project management and implementation units, project management consultants, members of steering and evaluation committees, beneficiaries, and other stakeholders, and thus help strengthen project administration. The TA beneficiaries will better understand ADB's anticorruption policy and related procedures and be able to identify and address potential fraud and corruption in ADB-financed activities. In March 2008, ADB approved RETA 6447 for Anticorruption Seminars for 2008 and 2009. The objective of the Technical Assistance (TA) is to reduce the risk of fraud and corruption in selected ADB-financed projects by ? Increasing the understanding of and compliance with ADB's anticorruption policy, and ? Raising awareness of potential irregularities among those responsible for implementing the projects. Stakeholders of development activities include a range of individuals and institutions, including executing and implementing agencies, project management, audit and implementation units, project management consultants, steering and evaluation committees, beneficiaries, and others. The purpose of these seminars is to increase the awareness of stakeholders of the impacts of fraud and corruption on projects. Through facilitation discussions about ADB's anticorruption policy and ADB-financed activities, it is hoped that stakeholders can ? Identify and address potential fraud and corruption, ? Safeguard assets and resources, and ? Contribute to an integrity-based project environment. The TA is being implemented by ADB's Office of the Auditor General, Integrity Division (OAGI). OAGI launched RETA 6447 in Papua New Guinea in October 2008. The first project to be covered by the RETA is Loan 2398/2399-PNG: Lae Port Development Project. This project was selected for the RETA due to the size of the loan and the complexity of the undertaking. Teamwork?for?Integrity?and?Effectiveness?in?the?Lae?Port?Development?Project? ? Executive Summary OAGI held two-day participatory workshops in Lae (20-21 October) and Port Moresby (23-24 October 2008) as part of Regional Technical Assistance (RETA) 6447: Anticorruption Seminars. The Coverdale Organization, Inc. facilitated these workshops. ADB's anticorruption policy was used as a framework for interactive discussions with stakeholders in and around Loan 2398/2399-PNG: Lae Port Development Project. Participants in the workshop comprised representatives of the project, local and national government, civil society, communities and private sector, who worked in teams to develop a shared vision for the project as a model for effective, integrity-based development. Both workshops developed simple action plans, including personal commitments from team members, to make that vision a reality. Participants shared their views on the meaning of integrity and effectiveness and discussed the potential positive and negative impacts of eventual project outcomes. Keys to the workshops' success included: ? Representation from public and private sectors, including ethnic groups; ? Willing and active participants; ? Development of a cadre of trainers who can work to sustain the process; and ? Assistance provided by the IPBC, facilitators, ADB Resident Mission and ADB project staff. Developed a consensus-based, shared vision with regards to integrity and effectiveness in the implementation of the Lae Port Project; ? Developed action plans to carry out that vision; ? Sharpened relevant and related integrity-based management skills to improve cooperation, willing compliance, transparency, and accountability; and ? Strengthened teamwork between stakeholder groups. Methodologies incorporated into the training included team building, planning, role play, role reversal, brainstorming and reporting. While the composition, size and activities of the workshops differed between Lae and Port Moresby, both found strong interest and active commitment to ensuring that the Lae Port Development Project results in effective and integrity-based project outcomes. This report documents the process of developing a shared vision and identifying steps to realize it. The strength of participants' commitment is evidenced by their contributions, which are presented in this report. While readers may draw their own conclusions on shared themes and points of contrast, the words and photos from the workshops capture the spirit of teamwork and cooperation experienced. As a result of the workshops, there was agreement by participants to develop an Integrity Network to assist the Lae Port Development Project in achieving maximum success. Continued interest by participants can help ensure transparency and accountability of the project. However, this requires nurturing and follow-up. It is hoped that the initiative begun in the workshops will continue, in an environment of active solicitation of interest and support for stakeholder involvement at all stages of the project. A journey of a thousand miles begins with the first step. Modest support to sustain the commitment generated by the workshops can help sustain commitment and effectively use the aspirations of stakeholders for the benefit of the project and the community. IV. Workshop Activities Task 1: Personal Aims In this session, participants worked together to present their personal interests in the workshop. The purpose of this question was to give the facilitation team insights to shape the workshop design for greater participant satisfaction and engagement. Participants provided the following responses: ? See how Lae Port Project can proceed and conclude with few problems. ? See the port built for the benefit of all Papua New Guineans. ? Learn and contribute constructively towards this workshop for the purpose of national economic growth of my country – PNG and growth of the people. ? Get a better sense of how "bris kanda" can serve those affected by the port development. ? Contribute ideas to assist in the development of the project in terms of law and order situations. ? Task 3: Imagining Impacts In this session, groups were asked to discuss the positive and negative impacts resulting from two different scenarios: the project having good standards of integrity and effectiveness and poor standards of integrity and effectiveness. The purpose of this discussion was to identify some of the intended and unintended consequences, and to start to identify who might benefit and who might get hurt as a result. Barriers put in place by vested interests so things/processes may be slow. From the top management down to the tea boy must abide by only one law to get the job done and on schedule. Any mistake by one person or group will have very big impact on the whole project and would cost a lot of time and money. Before employing anyone for the Port Project we would need to screen applicants before employing them thus there is no 'Wantok System'. Trupela pasin. Lack of preparedness of Stakeholders to embrace good standards leads to delay and high costs. If you are a 'Wantok' it is easier to get things done. Poor Occupational Health and Safety standards that could lead to high incident rates, loss time injury and higher insurance claims. Good working relationships Political interference Benefits only few people. Bribery of security. No 'Wantok System' as ID card system is used by/for Security. Rich become richer, Poor become poorer. Increase employment for a particular ethnic group. Could cause environmental damages. Efficient movement of imports and exports. Corrupt practices. Quick flow of cargo. Customs revenue could drop or decrease. Saves money and time for all stakeholders. Greed, self interest, bribes, infighting for top jobs will slow down good progress. Corruption by politicians. Recommendations – avoid ambiguous concepts. ? The interaction between participants and the presentations. ? I value the sharing of ideas from different trades of life. ? Television presentation. Retain the success by involving all members to participate in the tv presentation and not just 2-3 people. ? Brainstorming ideas; the process is actually a success! ? The emphasis on personal commitments towards a project "What can I do for the project?" Clarify and explain the tasks involved in different phases of the workshops before starting each one. ? Participants should be taught to detail so they can contribute efficiently. ? Improve briefs of processes involved; give more background on tasks before group work. ? None… very well organized. ? Use of conflicting words which may stimulate/offend other partners. ? Confirmation of the same participants to work with the development of the port. So as do the community doesn't feel that their interest is not being ignored. ? More involvement of authorities who make decisions to avoid confusions. ? Get right people who would have answers to the unanswered questions rather than holding us in suspense by putting on hold. ? Ample time to inform participants that all can attend such an important workshop. ? The questions seemed ambiguous though this was probably deliberate. A more thorough opening would have put the first day into perspective. ? At the beginning of the workshop, IPBC should explain project outline (say 10 minutes). Most of the information communities request to IPBC is there. ? Wrap-up by ADB about integrity and effectiveness (1st day morning) is necessary before going to the next stage. ? We should try to improve in time management. ? Try to include local knowledge persons to improve language barrier in defining complicated terms. ? Improve on interpretation or more elaboration on technical terms in order for simple people to understand and meaningfully participate. My plan for the next meeting is to come prepared. ? Use variety of presentation tools: charts, white boards, OHP, powerpoint. ? It would think timing was a big issue. Some of us we lost and did not know what we were doing in this workshop. Maybe next time give at 4 weeks before workshop so participants may plan for this as well. ? Language. Interpretation. ? Clear content with simple English used. English is not our mother tongue. ? We should try to eliminate narrowing down of discussion to one group in order to create personal attack type question. ? Language problem. Use local language for effective communication. Use local expert to translate English to local language (pidgin). ? I seriously think it went well – maybe the facilitators needed a little more guidance in actually guiding the teams appropriately. ? Language. The use of flowery terms and "aid speak" should be limited, particularly for those for whom English is not the first language. ?
